Terms of Service

Agreement to Terms


These Terms of Service ("Terms") govern your access to and use of DuePilot, operated by DuePilot Inc. ("Company," "we," "us," or "our"). By accessing or using DuePilot, you agree to be bound by these Terms. If you disagree, do not use the service.

Service Description


DuePilot is a software-as-a-service platform that provides accounts receivable automation, including AI-powered collection email sequences, customer payment scoring, QuickBooks integration, and analytics. We do not act as a debt collector, attorney, or financial advisor. DuePilot is a technology tool to assist businesses in managing their own accounts receivable.

Eligibility


You must be at least 18 years old and have the legal authority to enter into contracts on behalf of your business to use DuePilot. DuePilot is intended for use by businesses collecting their own business-to-business or business-to-consumer receivables. The service is not licensed or intended for use by third-party debt collectors or collection agencies.

Account Responsibilities


You are responsible for maintaining the security of your account credentials. You must notify us immediately at security@duepilot.ai if you suspect unauthorized access. You are responsible for all actions taken under your account.

You agree to provide accurate, complete, and current information when creating your account and to keep this information updated.

Subscription and Billing


Auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price. You will receive a reminder email before annual renewal.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain access to the service until that date.

Refund policy: Monthly plans: no refunds for the current billing period. Annual plans: pro-rata refunds available within 30 days of annual renewal, except for the first annual subscription (which is covered by the 14-day free trial).

Free trial: New accounts receive a 14-day free trial with full access to all features on the selected plan. No credit card is required to start. After the trial, you must enter payment information to continue.

Price changes: We may change prices with 30 days' notice via email. Continued use of the service after the price change date constitutes acceptance of the new price.

Acceptable Use


You agree to use DuePilot only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

  • Use DuePilot as a third-party debt collection agency

  • Send collection communications that violate the Fair Debt Collection Practices Act (FDCPA) or applicable state laws

  • Use DuePilot to harass, threaten, or intimidate customers

  • Use DuePilot to collect debts that are past the statute of limitations without appropriate disclosures

  • Misrepresent your identity or the amount owed in collection communications

  • Use DuePilot for any illegal purpose or in violation of any applicable law

  • Attempt to reverse-engineer, copy, or create derivative works of the platform

DuePilot reserves the right to terminate accounts that violate these acceptable use provisions without refund.

Intellectual Property


DuePilot and its original content, features, and functionality are owned by DuePilot Inc. and are protected by US and international copyright, trademark, and other intellectual property laws.

You retain ownership of all data you import or create within DuePilot. By using DuePilot, you grant us a limited, non-exclusive license to use your data solely to provide and improve the service.

Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DUEPILOT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL FEES PAID BY YOU TO DUEPILOT IN THE THREE MONTHS PRECEDING THE CLAIM.

Disclaimer of Warranties


THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Termination


Either party may terminate these Terms at any time. DuePilot may suspend or terminate your account immediately for material breach of these Terms, including violation of acceptable use provisions.

Upon termination, your right to use the service ceases immediately. We will retain your data for 90 days to allow export, after which it will be permanently deleted.

Governing Law


These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in San Francisco, California.
